$2.13 for dish-washing? Servers sue over side work

A Ruby Tuesday server is suing the restaurant chain, claiming she is required to do excessive untipped side work, in a federal lawsuit she hopes will become a class action involving thousands of workers nationwide.

The national minimum wage for tipped workers is just $2.13 per hour, a rate that hasn’t changed in 25 years. Workers are allowed to be paid so little because tips are considered part of their wages. Tipped workers can legally do some untipped side work like wiping tables, but it can’t take up more than 20 percent of their work day.
